THE OFFICIAL KMVU-TV & DAIRY QUEEN PLAYER OF THE WEEK PROMOTION DETAILS KMVU-TV FOX 26 will conduct a weekly campaign recognizing a local middle school or high school athlete for a unique achievement. There will be one athlete chosen every week. Viewers will be directed to go to the KMVU-TV FOX 26’s website and click on the Dairy Queen logo and submit the name of their favorite athlete, their age, which middle or high school, sport and why they should be selected. KMVU-TV will then pick one middle or high school athlete from the viewers’ favorites. The winner will be announced on FOX 26 News First at Ten and will be featured on the website. The cake certificate will be mailed to the winner of the Dairy Queen athlete of the week and the winner may be able to redeem the cake certificate at any Dairy Queen in the Rogue Valley for a frosted cake with his/her school logo. By accepting the prize, the winner acknowledges his or her compliance with these Official Rules. By accepting the prize, the winners are also responsible for all expenses incurred when traveling to and from destinations pertaining to the awarded prize. Winners are responsible for all taxes, if any, incurred by winning prizes. Winners are responsible for any applicable fees, service charges, surcharges, and all insurance, federal, state and local taxes, if any, and any other unspecified expenses associated with acceptance or use of any prize. Prizes and cake certificates are non-transferable. No cash redemption or prize substitution allowed. Sponsors reserve the right, in their sole and complete discretion, to substitute a prize of equal or greater value if an advertised prize becomes unavailable All federal, state and local laws and regulations apply. KMVU-TV FOX 26 reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this promotion or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in KMVU-TV FOX 26's sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, (b) the promotion or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Official Rules, or (c) the promotion is otherwise not capable of running as planned. By accepting the prize, participants agree to release and hold harmless KMVU-TV FOX 26 and Dairy Queen and their parent, subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, and each of the foregoing entities' employees, officers, directors, shareholders and agents (collectively the "Released Parties"), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the promotion or acceptance or use of any prize including without limitation, the Prize. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by a Sponsor due to technical problems, postal delays, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the promotion, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible and/or unintelligible (or any combination thereof).
